INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in October 2015. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in October 2015. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of October 2015 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Division 2 CANADA AMENDMENTS

Section 2.A Canada Acts

Canada Labour Code (Part II) : S.C. 2015, c. 36, s. 87 is in force adding subsection 123(3) to the Code to explicitly state that the occupational health and safety provisions apply to those, such as interns, who may not be employees, but perform various duties with the primary purpose of acquiring knowledge or experience.

Aviation Occupational Health and Safety Regulations (Canada Labour Code): SOR/2015-211 amends the regulation to align it with the Canada Labour Code and explicitly state that the regulation applies to workers such as interns who are not employees but often act as if they were employees of the employer.

Maritime Occupational Health and Safety Regulations (Canada Labour Code): SOR/2015-211 amends the regulation to align it with the Canada Labour Code and explicitly state that the regulation applies to workers such as interns who are not employees but often act as if they were employees of the employer.

National Energy Board Act Part VI (Oil and Gas) Regulations (Miscellaneous Program) (National Energy Board Act): SOR/2015-212 amends the regulation to define "natural gas" in section 10.1 for the purposes of supporting the development of Canadian LNG export facilities by providing LNG exporters with some flexibility in the composition of natural gas to be exported under 40-year licenses.

Oil and Gas Occupational Safety and Health Regulations (Canada Labour Code): SOR/2015-211 amends the regulation to align it with the Canada Labour Code and explictly state that the regulation applies to those who are interns and therefore not employees but often act as if they were employees of the employer.

Passenger Automobile and Light Truck Greenhouse Gas Emission Regulations (Canadian Environmental Protection Act, 1999): SOR/2015-186 amends the regulation to align the regulation with the United States (U.S.) Environmental Protection Agency (EPA) Tier 3 standards. These amendments impose stricter limits on air pollutant emissions from new passenger cars, light-duty trucks and certain heavy-duty vehicles, beginning with the 2017 model year.

Sulfphur in Gasoline (Canadian Environmental Protection Act, 1999): SOR/2015-187 amends the regulation to align with the U.S. EPA Tier 3 standards. These include lower limits on the sulphur content of gasoline and stricter limits on air pollutant emissions from new passenger cars, light-duty trucks and certain heavy-duty vehicles. These changes will enable compliance with the more stringent vehicle emission standards for the 2017 and later model years.

Tobacco and Smoking Reduction Act : S.A. 2013, c. 25 amends the Act to prohibit the sale of flavoured tobacco products.

Specified Gas Reporting Regulation (Climate Change and Emissions Management Act): Alta. Reg. 106/2015 amends the definition for "facility" and sections 5 and 7.

Oil and Gas Conservation Rules (Oil and Gas Conservation Act): Alta. Reg. 114/2015 amends Part 16.5 (Orphan Fund) to update formula dates.

Pesticide (Ministerial) Regulation (Environmental Protection and Enhancement Act): Alta. Reg. 101/2015 amends the regulation to amend the expiration date.

Specified Gas Emitters Regulation [SGER] (Climate Change and Emissions Management Act): The SGER is an intensity-based approach to the regulation and restriction of carbon emissions. Alta. Reg. 104/2015 amends the regulation so that it expires January 01, 2017. Large emitters will be required to reduce emissions intensity by 15% by January 1, 2016 and 20% by January 1, 2017. There remains no hard cap on total carbon emissions.

Tobacco and Smoking Reduction Regulation : Alta. Reg. 201/2014 amends the regulation to prohibit the sale of flavoured tobacco products and establish exemptions.

Regulatory Amendments to Update Ontario Drinking Water Quality Standards, and Testing and Reporting Requirements

These regulatory amendments would update the Ontario Drinking Water Quality Standards, as well as related sampling, testing and reporting requirements. They would also respond to stakeholder comments by providing phase-in periods and ensuring that the existing level of drinking water protection for consumers is maintained. Road-Building Machines

The Ministry of Transportation (MTO) is undertaking a review of the definition of a road-building machine (RBM) as it is currently found in the Highway Traffic Act (HTA).

Amendment to O. Reg 347 under the Environmental Protection Act Regarding the Hazardous Waste Program Fee The ministry is proposing a regulation to amend Regulation 347 and replace the Minister's Requirement for Hazardous Waste Fees. The proposed regulation, if made, would raise the tonnage component of the Hazardous Waste Fees from $10 per tonne to $20 per tonne for hazardous waste transferred or disposed of between January 1, 2016 and December 31, 2016. The tonnage component of the Hazardous Waste Fees would be further increased to $30 per tonne as of January 1, 2017.

O. Reg. 359/09 Renewable Energy Approvals under Part V.0.1 of the Act (REA regulation) is intended to support the Ontario Government's Green Energy initiative to expand renewable energy generation, encourage energy conservation and promote the creation of clean energy jobs, while upholding our commitment to protecting the environment.
