INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in November 2015. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in November 2015. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of November 2015 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Division 2 BRITISH COLUMBIA AMENDMENTS

Section 2.A British Columbia Acts

Forest and Range Practices Act : S.B.C. 2015, c. 26 is now in force and amends section 118 (Power to enter into agreements).

Motor Vehicle Act : S.B.C. 2015, c. 13 is partly in force and amends the Act throughout. In addition to several other amendments, Section 15.2 (When drivers must not use leftmost lane) has been added to the Act.

Workers’ Compensation Act : S.B.C. 2015, c. 22 is now fully in force. In addition to other administrative changes and consequential amendments, sections 186.1 (Compliance agreements) and 196.1 (Administrative penalties - lower maximum amount) have been added to the Act.

Section 2.B British Columbia Regulations

Carbon Tax Regulation (Carbon Tax Act): B.C. Reg. 79/2015 amends section 46 (Offences).

Fee, Levy and Security Regulation (Oil and Gas Activities Act): In addition to other amendments and the repeal of subsection 5(3) B.C. Reg. 59/2015 adds sections 4.1 (Fees for advice and consultation services), 11.1 (Fees respecting construction of LNG facility), 11.2 (Fees respecting operation of LNG facility) to the regulation.

Woodlot Licence Planning and Practices Regulation (Forest and Range Practices Act): B.C. Reg. 64/2015 repeals and replaces section 76 (Reports - annual and other).

Crown Lands Act : S. M. 2015, c. 4 amends the Act to add a definition for "officer".

Ecological Reserves Act : S. M. 2015, c. 4 amends section 10’s definition for "officer" to conform with the Conservation Officers Act.

Endangered Species and Ecosystems Act : S. M. 2015, c. 4 amends the definition for "officer" to cite the Conservation Officers Act.

Environment Act : S.M. 2015, c. 4 amends the definition for "environment officer".

Highway Traffic Act : S.M. 2013, c. 49 is now in force and amends the Act to simplify its language. It amends the Act so that all vehicles with seating for 10 or more passengers or those 4,500 kg or over are subject to the same operational and mechanical safety rules. A new category of heavy motor vehicles has been established "regulated vehicles" bringing previously exempt commercial trucks under it. Future regulations may exempt some motor vehicles from the definitions "commercial truck" and "regulated vehicle". As well, several amendments to the heavy vehicle safety framework are intended to ensure its effectiveness and as well as make minor corrections.

Off-Road Vehicles Act : S. M. 2015, c. 4 amends the definition for "peace officer".

Water Protection Act : S. M. 2015, c. 4 adds a definition for " officer".

Water Rights Act : S. M. 2015, c. 4 amends the definition for " officer".

Wildfires Act : S. M. 2015, c. 4 amends the definition for " officer".

Wildlife Act : In addition to other amendments, S. M. 2014, c. 19 adds sections 86.1 (Liability for value of animal involved in offence), 86.2 (Notice of potential liability when charged), 86.3 (Action to recover amount owing), 86.4 (Calculating value), 86.5 (Payment into wildlife enhancement account), 86.6 (Licences cancelled while amounts owing) and 91.1 (Incorporation by reference). S.M. 2015, c. 4 amends the definition for "officer".

Section 2.B Manitoba Regulations

Workplace Safety and Health Regulation (Workplace Safety and Health Act): Man. Reg. 129/2015 amends the regulation to repeal and replace Part 35 (Workplace Hazardous Products Information Systems).

Division 2 PRINCE EDWARD ISLAND AMENDMENTS

Section 2.A Prince Edward Island Acts

Environment Tax Act : S.P.E.I. 2015, c. 5 amends the Act to add sections 1.1 (Definition, Crown in right of the province), 1.2 (Registration certificate, requirement for), 1.3 (Display at place of business), 1.4 (Registered vendor is an agent of the Minister), 1.5 (Registration certificate required by assignee, liquidator, administrator and trustee) and 1.6 (Bill of sale).

Highway Traffic Act : S.P.E.I. 2015, c. 7 amends the Act throughout to reference to driving while impaired by drug use or the combination of drugs and alcohol. The Schedule is amended to increase fines for a conviction for driving while using or holding certain electronic devices.

Smoke Free Places Act : S.P.E.I 2015, c. 15 amends the Act so that prohibitions and requirements respecting smoking now apply to smoking tobacco products and electronic smoking devices, waterpipes or similar devices or instruments. The section also amends a reference to an old department name and provides for a place to be designated in the regulations as a "public place".

Section 2.B Prince Edward Island Regulations

Drinking Water and Wastewater Facility Operating Regulations (Environmental Protection Act): EC2015-463 amends the regulation to amend a number of definitions, adds a definition for "operator-in-charge" and repeals definitions for "small public drinking water supply facility" and "small wastewater collection facility", as these terms are no longer used in the Act. References throughout replace "Department" with "Minister" because it is the Minister who is a legal person able to act. Amendments have been made throughout concerning the designation of an operator-in-charge of a facility. Amendments have been made to the drinking water monitoring requirements for semi-public drinking supply systems and Class A and Class B public drinking water supply facilities. In addition to amendments to Schedule A and B, Schedule C has been repealed and replaced.
