INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in February 2016. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in February 2016. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of February 2016 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Environmental Management Act: S.B.C. 2015, c. 41 is in force amending s. 139. S.C.B. 2015, c. 10 is in force amending ss. 93, 94, 102, adding s. 93.1 (Application of Administrative Tribunals Act) and repealing ss. 104-105. http://www.ccohs.ca/legislation/documents/bc/bceema/bcaenve0.xml

Integrated Pest Management Act : S.B.C. 2015, c. 10 is in force amending ss. 14 and 35. S.B.C. 2015, c. 41 is in force making a minor amendment to s. 13.

Land Act : S.B.C. 2015, c. 26 is in force making amendments related to applications for crown lands.

Utilities Commission Act : S.B.C 2015, c. 41 is in force making a minor amendment to s. 45. S.B.C. 2015, c. 42 is in force making amendments related to the chief operating officer and clarifying how adopted reliability standards are applied. S.B.C. 2015, c. 10 is in force amending s. 2 and adding s. 2.1 (Application of Administrative Tribunals Act).

Workers' Compensation Act : S.B.C. 2015, c. 10, s. 200 is in force amending s. 232 and replacing s. 245.1 (Application of Administrative Tribunals Act to appeal tribunal). S.B.C. 2015, c. 38, all sections are now in force amending ss. 69, 82.1, 86, 130, 132, 172 and 174-176 related to employer reports of investigations.

Section 2.B British Columbia Regulations

Occupational Health and Safety Regulation (Workers' Compensation Act): B.C. Reg. 30/2015 is in force making amendments to align with WHMIS 2015. B.C. Reg. 195/2015 is in force repealing s. 3.4 (Incident Investigation Reports) and amending s. 24.34.

Greenhouse Gas Reduction (Clean Energy) Regulation (Clean Energy Act): B.C. Reg. 98/2015 amends definitions in s. 1 and prescribed undertakings in s. 2.

Power Engineers, Boiler, Pressure Vessel and Refrigeration Safety Regulation (Safety Standards Act): B.C. Reg. 113/2015 updates references to standards in s. 2 and in the Schedule.

General (Aggregate Resources Act): O. Reg. 371/15 amends the regulation to update Schedule 4.

General - Waste Management (Environmental Protection Act): O. Reg. 372/15 amends the regulation to add section 26.1 (Fees).

Ontario Drinking-Water Quality (Standards Safe Drinking Water Act, 2002): O. Reg. 373/15 is partially in force and repeals and replaces Schedule 2 (Chemical Standards) of the regulation. The reset of the regulation will come into force in 2017 and 2020 amending the new Schedule 2.

Drinking-Water Systems (Standards Safe Drinking Water Act, 2002): O. Reg. 374/15 is partly in force and amends the regulation concerning trihalomethanes.

Fire Prevention Act : S.P.E.I. 2015, c. 28 is in force updating references to the Department of Communities, Land and Environment, Justice and Public Safety and Attorney General and to the Minister of Finance. S.P.E.I. 2006, c. 16, s. 63 is in force amending s. 33 to remove "constables".

Highway Traffic Act : S.P.E.I. 2015, c. 28, s. 3 updates references to government departments in ss. 1, 135 and 264. S.P.E.I. 2015, c. 36 makes minor amendments. S.P.E.I. 2015, c. 30 changes the time period to a three year period for second and third suspensions in s. 277.1.

Natural Areas Protection Act : S.P.E.I. 2015, c. 28, s. 3 is in force updating reference to the Department of Communities, Land and Environment.

Occupational Health and Safety Act : S.P.E.I. 2015, c. 37 is in force amending ss. 5 and 6, regarding the Director of Occupational Health and Safety and s. 46.

Off-Highway Vehicle Act : S.P.E.I. 2015, c. 38 is in force amending the fine in s. 1.2 for an offence while operating an off-highway vehicle in Confederation Trail.

Renewable Energy Act : S.P.E.I. 2015, c. 28, s. 3 is in force updating reference to the Minister of Finance in s. 17.

Roads Act : S.P.E.I. 2015, c. 28 s. 3 is in force updating references to the Minister/Department of Transportation, Infrastructure and Energy and Minister of Finance. S.P.E.I. 2015, c. 36 makes minor amendments.
