INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in September 2016. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in September 2016. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of September 2016 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Nunavut Waters and Nunavut Surface Rights Tribunal Act : S.C. 2015, c. 19 adds Section 43.1 on the Board’s giving notice and exception; replaces Section 45 on term of licence; adds Sections 55.1-55.6 regarding time limits; replaces Section 56 on referral to Minister for approval; adds subsection 81.1 referring to Cost Recovery; and adds subsection 82.1.

Section 2.B Canada Regulations

Domestic Substances List (Canadian Environmental Protection Act, 1999) (SOR/94-311): SOR/2016-227 adds 1 and removes 1 substance from Part 1. SOR/2016-228 adds 13 substances to Part 1, adds 1 substance to Part 2 and adds 13 substances to Part 3. SOR/2016-229 adds 1 item to Part 6. SOR/2016-242 adds 9 substances to Part 1 and 10 substances to Part 3. SOR/2016-242 adds 1 item to Part 5.

Mackenzie Valley Land Use Regulations (Mackenzie Valley Resource Management Act): SOR/2016-128 applies extensive amendments.

Mackenzie Valley Federal Areas Waters Regulations (Mackenzie Valley Resource Management Act): SOR/2016-130 changes the regulation title to "Mackenzie Valley Federal Areas Waters Regulations" from "Northwest Territories Waters Regulations." Minor amendments are made to sections 1 and 2. Replaces sections 4 and 7; and subsections 5(3), 8(1), 8(2), 10(1), 12(1), 12(2), 14(1), 14(2)(c) and (d), 15(1) and items 4 to 6 of Schedule I. Repeals paragraph 12(3)(c) and section 13.

Metal Mining Effluent Regulations (Fisheries Act): SOR/2016-196 adds items 25-27 to Schedule 2.

Migratory Birds Regulations (Migratory Birds Convention Act): SOR/2016-126 applies extensive amendments.

National Energy Board Onshore Pipeline Regulations (National Energy Board Act): SOR 2016-134 amends this regulation by adding a new section 47.2 Damage Prevention Program requiring a company to develop, implement and maintain a damage prevention program that prevents and mitigates damage to its pipeline.

Territorial Land Use Regulations (Territorial Lands Act): SOR/2016-132 applies extensive amendments.

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act): SOR/2016-95 applies extensive amendments to this regulation.

Weed Control Regulation (Weed Control Act): Alta. Reg. 125/2016 repeals Section 18 Expiry and revises several plant names designated as prohibited noxious weeds in the Schedule.

Section 2.A British Columbia Acts

Carbon Tax Act : S.B.C. 2016, c. 10 sections are in force amending ss. 28-30 and s. 35.

Land Act : S.B.C. 2016, c. 4 replaces Section 37 Necessary information to be supplied on request.

Motor Vehicle Act : S.B.C. 2015, c. 11 makes a minor amendment to Section 231.1, subsections (1) and (2) to include reference to e-cigarettes.

Petroleum and Natural Gas Act : S.B.C. 2016, c. 4 amends wording in Section 47(3)(a) and (b), and Section 48.

Tobacco and Vapour Products Control Act : S.B.C. 2015, c. 11 applies various amendments to this Act, including replacing the title (see above), formerly titled Tobacco Control Act. Definitions for "activated e-cigarette," "e-cigarette," "e-substance," and "vapour product" are added to Section 1. Section 2.21 No tobacco or vapour product use on healthy board property, and Section 2.41 Exception for prescribed medical products is added. Section 10.3 Removing tobacco or vapour products from public display is repealed and replaced. Amendments to wording in various Sections and subsections are applied as well.

Section 2.B British Columbia Regulations

Tobacco and Vapour Products Control Regulation (Tobacco and Vapour Products Control Act): B.C. Reg. 149/2016 repeals and replaces the title (see above), formerly titled Tobacco Control Regulation. Definitions for "minor" and "retail establishment" are added to Section 1. Various sections are amended to include references to using an e-cigarette or holding an activated e-cigarette. Section 4.3 is repealed and Section 4.3.1. is amended to include reference to vapour products. Section 5 is repealed and replaced with Section 5 Warning Signs. Various amendments are applied to Sections 13, 17, 18 and 19, and Schedule 1 is repealed and substituted.

Water Sustainability Act : S.B.C. 2016, c. 4 makes a minor amendment to wording in Section 33(2)(b)(iii).

Weed Control Act : S.B.C. 2016, c. 4 amends wording in Section 7, subsections (2) and (3).

The purpose of this notice is to inform the public of the Ministry of the Environment and Climate Change's review of components of the Environmental Bill of Rights and to seek public feedback.

Revocation of Ontario Regulation 153/99 - Ontario Power Generation Inc. (source: Environmental Registry)

The Ministry of the Environment and Climate Change (MOECC) proposes revoke Ontario Regulation 153/99 - Ontario Power Generation (O. Reg. 153/99) under the Environmental Protection Act. O. Reg. 153/99 sets sulphur dioxide (SO2) and total nitrogen oxides (NOx) emission limits on Ontario Power Generation (OPG) facilities in the aggregate. The Regulation is no longer needed in view of OPG having substantially reduced its SO2 and NOx emissions as a result of Ontario's phase-out of coal.

Amendments to the Technical Guide to Renewable Energy Approvals (source: Environmental Registry)

The Ministry of the Environment and Climate Change is proposing a number of revisions and updates to the Ministry's Technical Guide to Renewable Energy Approvals to provide additional guidance in support of the regulatory amendments which came into effect on May 1, 2016 (EBR Decision Notice 012-4493). The purpose of the Technical Guide is to provide an explanation of the requirements to complete an application for an REA in accordance with O. Reg. 359/09 under the Environment.

Regulatory proposal to require eligible activities with air and/or noise emissions to register on the Environmental Activity and Sector Registry (EASR). (source: Environmental Registry)

The ministry is seeking input on a proposed new EASR regulation for activities with air and noise emissions.

Regulation of invasive species under the Ontario Invasive Species Act, 2015 (source: Environmental Registry)

The Ontario Invasive Species Act, 2015 comes into force on November 3, 2016. The Act provides the power to make regulations prescribing invasive species and classifying them as either prohibited or restricted. A prohibited invasive species is subject to all of the prohibitions in section 7 of the Act unless there are exceptions provided in the regulation.

Drive Clean Program - Repair Cost Limit/Conditional Pass, Drive Clean Inspectors and Repair Technicians, Resale Vehicle Test Requirements, and Islands without Access to Year Round Ferry Service (Remote Islands) (source: Environmental Registry)

The Ministry of the Environment and Climate Change (MOECC) is proposing a number of improvements to Ontario's Drive Clean program that require regulatory changes. MOECC is proposing that Ontario Regulation 361/98 (Motor Vehicles), made under the Environmental Protection Act (O. Reg. 361/98) be amended, and that the Ministry of Transportation bring forward proposed amendments to Regulation 628 (Vehicle Permits), made under the Highway Traffic Act (Regulation 628).

Updates to Ontario's Drinking Water Quality Standards and other regulations of the Safe Drinking Water Act, 2002, related to: lead in schools and day nurseries; drinking water systems; drinking water testing services; and drinking water operator certification (source: Environmental Registry)

Ontario has established a comprehensive safety net for drinking water with a source to tap focus. Division 2 ONTARIO AMENDMENTS

Section 2.A Ontario Acts

Health Protection and Promotion Act : S.O. 2011, c. 7 amends Section 69 Acting M.O.H. to include information on approvals required, exception, transitional, conditions, time limit and renewal. Section 77.4 Possession of premises for temporary isolation facility is updated with additions. Section 77.9 Directives to boards and medical officers is added, covering directives, restriction, compliance, required, duration, termination or renewal, and consultation.

Occupational Health and Safety Act : S.O. 2016, c. 2 Sch. 4 amends the Act by updating the definition of "workplace harassment" and adding the definition "workplace sexual harassment" in subsection 1(1). Section 1 is added to with a subsection called "workplace harassment." Section 32.0.6 Program, harassment is amended. Section 32.0.7 is repealed and substituted with Section 32.0.7 Duties re: harassment and Section 32.0.8 Information and instruction, harassment. Section 55.3 Order for workplace harassment investigation is added.

Planning Act : S.O. 2015, c. 26 applies extensive amendments to this Act.

Section 2.B Ontario Regulations

Confined Spaces (Occupational Health and Safety Act): O. Reg. 346/15 revokes clause (d) of the definition of "acceptable atmospheric levels" in section 1 and replaces with new text.

Control of Exposure to Biological or Chemical Agents (Occupational Health and Safety Act): O. Reg. 347/15 revokes subsection 2(1), amends subsection 7.2(1), and amends the regulation by adding section 2.1 referring to where to find approved codes of practices relating to exposure of workers to biological or chemical agents.

General (Pesticides Act): O. Reg. 139/15 applies extensive amendments to this regulation.

Restricted Use of Left Lanes by Commercial Motor Vehicles (Highway Traffic Act): O. Reg. 201/16 replaces "the King’s Highway" with "a highway" in subsections 1(1), 2(2), 3(2) and 3(3). Also revokes Schedule 5 and substitutes with Schedule 5 Highway 407 and Schedule 5.1 Highway 407 East.

Species at Risk in Ontario List (Endangered Species Act): O. Reg. 200/16 revokes and replaces Schedules 1, 2, 3, 4 with Schedule 1 Extirpated Species, Schedule 2 Endangered Species, Schedule 3 Threatened Species, and Schedule 4 Special Concern Species.

Environment Tax Act : S.P.E.I. 2016, c. 6 substitutes "education authority" for "school board" in section 1(1)(d).

Section 2.B Prince Edward Island Regulations

Bicycle Safety Helmet Regulations (Highway Traffic Act): EC 2016-432 amends this regulation in Clause 2(1)(a) by revoking references in subclauses (i), (vi), and (vii) to three out-dated standards that were applicable to bicycle safety helmets and substituting references to the current standards applicable to bicycle safety helmets.

Commercial Vehicle (Cargo Securement) Regulations (Highway Traffic Act): EC 2016-433 amends section 10 of Part 4 of Schedule I to the regulations to revoke a reference to an out-dated ASTM standard specification for strapping, flat steel and seals and substitute a reference to the current ASTM standard that deals with those specifications.

Slow Moving Vehicle Signs Regulations (Highway Traffic Act): EC 2016-435 amends section 1 of the regulations to revoke the citations of an out-dated CSA standard applicable to slow moving vehicle signs, and substitute a reference to the current CSA standard. Also corrects minor grammatical errors in clauses 1(a) and (b).

Vehicle Standards Regulations (Highway Traffic Act): EC 2016-436 amends clause 3(b) of the regulations to delete references to eight out-dated standards and substitute references to the current standards applicable to motor homes and recreational vehicles: CSA Z240 MH Series 92 (R2005), and CSA Z240 RV Series-14. Also amends section 4 to delete references to out-dated standards and substitute references to the current CSA standards for vehicle lighting equipment and the current ANSI standard for glazing materials.
