INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in November 2016. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in November 2016. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of November 2016 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Offsets Credits Regulatory Proposal

The Ministry is posting a regulatory proposal that provides an overview of the criteria, process and administrative requirements for the registration of greenhouse gas offset initiatives and the creation and issuance of offset credits that can be used to meet a compliance obligation.

Regulation for the issuance of new land use permits in accordance with Section 14(2.1) of the Provincial Parks and Conservation Reserves Act, 2006

Ontario is proposing a regulation that would allow the Minister to issue new LUPs in limited circumstances to support occupations authorized under ss. 13(2) of Ontario Regulation 347/07 ("primary occupations").

Proposed Amendments to Cap and Trade Program Regulations

On May 19, 2016, two regulations that form the backbone of the cap and trade program became law - the Cap and Trade Program Regulation (O. Reg. 144/16) which took effect July 1, 2016 and the Quantification, Reporting and Verification of Greenhouse Gas Emissions Regulation (O. Reg. 143/16) which takes effect January 1, 2017. The ministry is now proposing amendments to clarify policy, technical and administrative requirements of the program.

A regulation establishing a moratorium on the issuance of new or increasing permits to take water for water bottling

The proposed regulation would establish a moratorium on the issuance of new or increasing permits for water bottling by prohibiting a person from using groundwater for the purpose of manufacturing bottled water or manufacturing water as a product that is sold in other types of portable containers. Please refer to the Environmental Registry posting for more information.

Workers Compensation Act : R.S.P.E.I. 2015, c. 45 was proclaimed in force on 15/10/16. It amends subsection 40.1(1) to add an end date of January 1, 2016, that applies to the 2-day waiting period established in that section in respect of an accident that occurred on or after January 1, 2014. It adds a new section 40.11 to the Act that applies to claims for accidents that occur on and after January 1, 2016. There will be no waiting period in respect of accidents that occur on or after that date. The maximum wage loss benefits remain the same as under section 40.1 at 85% of the net maximum annual earnings. It also amends subsection 42(2) of the Act for consistency with amendments that were made to the Act in 2013 that changed the maximum wage loss benefits from 80% to 85% of the net maximum annual earnings.

Section 2.A Quebec Acts

Act respecting owners, operators and drivers of heavy vehicles : S.Q. 2005, c. 39 subsection 4(2) is in force amending paragraph 2 in s. 3 to change "net mass" to "weight".

Tobacco Control Act : S.Q. 2015, c. 28, ss. 6, 19 and 26 are in force amending s. 2.2 regarding smoking being prohibited a nine-metre radius from doors, vents or windows. Section 14.4 (prohibiting persons of a full age to purchase tobacco for minors) and s. 21.1 (prohibiting manufacturers from offering discounts to retail outlets or to their employees) are added.
