INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in April 2017. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in April 2017. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of April 2017 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Proposed Regulations to specify Administrative Penalties amounts under the Ontario College of Trades and Apprenticeship Act, 2009 (OCTAA)

Legislative amendments to OCTAA were enacted in December 2016 setting up the structure for a new administrative penalties framework to be used by the Ontario College of Trades in enforcing the OCTAA. As part of the implementation of these amendments, the Ministry of Labour is consulting on what the penalty amounts should be, and any other relevant details, including publication of notices of contravention.

Proposed regulation under the Public Lands Act to enable certain occupations of public land without the need for an occupancy instrument (e.g. land use permit, lease, license of occupation); and Proposed amendments to work permit requirements in Ontario Regulation 239/13 (Activities on Public Land and Shore Lands - Work Permits and Exemptions) under the Public Lands Act.

The purpose of this proposal is to provide a summary of the regulation proposal under consideration by the Ministry. Specifically, this notice outlines the proposed classes of structures; associated criteria; proposed circumstances in which the class occupational authority would not apply; and the proposed manner of giving notice to vacate the lands.

Amendments to Cap and Trade Program Regulation and Quantification, Reporting and Verification of Greenhouse Gas Emissions Regulation

On May 19, 2016, two regulations that form the backbone of the cap and trade program became law - the Cap and Trade Program Regulation (O. Reg. 144/16) which took effect July 1, 2016 and the Quantification, Reporting and Verification of Greenhouse Gas Emissions Regulation (O. Reg. 143/16) which took effect January 1, 2017.

Working at Heights Training

There is a two-year transition period for workers who, prior to April 1, 2015, met the fall protection training requirements set out in subsection 26.2(1) of the Construction Projects Regulation hese workers will have until April 1, 2017 to complete an approved working at heights training program.

This training requirement is in the Occupational Health and Safety Awareness and Training Regulation nd is in addition to training requirements under the Construction Regulation.
