He had unloaded his 1/2 ton truck and drove it forward away from the van so he could close the van door. He left the engine running and the gear shift lever in park. While he was closing the van door, the gear shift lever of the idling truck moved from the park position to the reverse position. This resulted in the truck backing up and crushing the worker against the van. Failure to correct a previously recognized safety defect (shift linkage malfunction) may have contributed to this fatality. *** APPLICABLE SECTION(S) OF INDUSTRIAL REGULATIONS *** 1. All workers are to be trained to recognize and avoid hazards associate with their work. (Subsection 9(2)(b) OHS Act) 2. Workers should not place themselves in areas which could prove harmful to their health and safety, including entrapment. 3. Motor vehicles should be properly maintained on a regular basis and when repairs to safety related components cannot be made immediately, the vehicle should be removed from service. 4.
